Welcome to PowerfulTools. These Terms and Conditions ("Terms") govern your access to and use of the PowerfulTools website located at https://powerfultools.dev (the "Site"), including all tools, features, content, and services offered through the Site (collectively, the "Services"). Please read these Terms carefully before using the Services.

1. Acceptance of Terms

By accessing or using the Services, creating an account, or making a purchase, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility

By using the Services, you represent and warrant that you have the legal capacity to enter into a binding agreement under applicable law. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features of the Services, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate and complete.
  • Maintain the security and confidentiality of your login credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately at powerfultoolsdev@gmail.com if you suspect any unauthorized use of your account.

PowerfulTools reserves the right to suspend or terminate any account that we reasonably believe has been compromised or is being used in violation of these Terms.

4. Description of Services

PowerfulTools provides a suite of web-based utility tools for creators and professionals. Our Services currently include, but are not limited to:

  • GPX Route Generator — Create Strava-compatible running routes with elevation data and pace variability.
  • YouTube Transcriber — Generate transcripts from YouTube videos or uploaded video files.
  • Text to Speech — Convert text to natural-sounding speech with multiple voice and language options.

We may add, modify, or discontinue tools and features at any time without prior notice. We are not obligated to maintain or support any particular tool indefinitely.

5. Credit System & Pricing

Access to the tools on PowerfulTools is governed by a credit-based system. Credits are required to use most tools and features.

  • Credit Packs: Credits may be purchased in one-time packs at the prices listed on the Site. Available packs and pricing are subject to change at any time.
  • Credit Costs: Each tool consumes a specified number of credits per use. The credit cost for each tool is displayed on the Site and may be adjusted at our discretion.
  • No Expiration: Purchased credits do not expire as long as your account remains active and in good standing.
  • Non-Transferable: Credits are tied to your account and may not be transferred, sold, or exchanged with other users.
  • Referral Credits: You may earn bonus credits through our referral program. Referral credits are subject to the same usage terms as purchased credits. PowerfulTools reserves the right to modify or discontinue the referral program at any time.

6. Subscriptions

PowerfulTools may offer subscription plans that provide recurring access to credits or Services on a periodic basis (e.g., monthly or annual). If you purchase a subscription:

  • No Free Trial: Subscriptions do not include a free trial period. Billing begins immediately upon subscribing.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription price at each renewal.
  • Cancellation: You may cancel your subscription at any time through the account settings on the Site or through Stripe's customer portal. Cancellation takes effect at the end of the current billing period. You will retain access to subscription benefits until the end of your paid period.
  • No Partial Refunds on Cancellation: If you cancel a subscription mid-cycle, you will not receive a prorated refund for the remaining time in the billing period.
  • Price Changes: We may change subscription pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing period following notice of the change.

7. Payment & Billing

All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you agree to the following:

  • You authorize PowerfulTools and Stripe to charge your selected payment method for any purchases or recurring subscription fees.
  • You are responsible for any applicable taxes, fees, or charges imposed by your jurisdiction in connection with your use of the Services.
  • If a payment fails or is declined, your access to paid features may be suspended until a valid payment method is provided.
  • All prices displayed on the Site are in US Dollars (USD) unless otherwise stated.

By providing payment information, you represent that you are authorized to use the payment method and that the information you provide is accurate.

8. Refund Policy

Refund requests are handled on a case-by-case basis. If you believe you are entitled to a refund for a credit purchase or subscription payment, please contact us at powerfultoolsdev@gmail.com with your account details and the reason for your request. We will review each request individually and respond in a reasonable timeframe. PowerfulTools reserves the right to approve or deny any refund request at its sole discretion.

9. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Services in any way that violates any applicable federal, state, local, or international law or regulation.
  • Attempt to gain unauthorized access to any part of the Services, other user accounts, or any systems or networks connected to the Services.
  • Use any automated means (bots, scrapers, crawlers, or similar) to access or interact with the Services without our prior written consent.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services or any part thereof.
  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
  • Use the Services to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Resell, redistribute, or commercially exploit the Services or any content generated through the Services without prior written consent.
  • Circumvent, disable, or otherwise interfere with any security-related features of the Services, including features that prevent or restrict use or copying.
  • Abuse the credit system, referral program, or any promotional features through fraud, manipulation, or the creation of multiple accounts.

PowerfulTools reserves the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including without limitation removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

10. Intellectual Property

Our Property: The Services, including all software, design, text, graphics, logos, icons, and other content on the Site, are the property of PowerfulTools and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services or included content without our prior written consent.

Your Content: You retain all rights to any content you create using the Services (such as generated routes, transcriptions, or audio files). By using the Services, you grant PowerfulTools a limited, non-exclusive license to process your content solely for the purpose of providing the Services to you.

11. Third-Party Services

The Services integrate with and rely upon various third-party services to deliver functionality. These include, but are not limited to:

  • Stripe — Payment processing
  • Supabase — Authentication and data storage
  • Deepgram — Speech-to-text and text-to-speech processing
  • OpenStreetMap / OSRM — Mapping and routing data
  • Google — OAuth authentication and analytics

Your use of these third-party services is subject to their respective terms of service and privacy policies. PowerfulTools is not responsible for the practices, content, or availability of third-party services. We do not warrant or guarantee the continued availability of any third-party integration.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POWERFULTOOLS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content generated by or through the Services, including but not limited to GPX routes, transcriptions, or synthesized audio.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POWERFULTOOLS, ITS OWNER, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF POWERFULTOOLS FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO POWERFULTOOLS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless PowerfulTools and its owner from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you create or submit through the Services.

15. Termination

PowerfulTools may suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if your use of the Services poses a risk to PowerfulTools, our users, or any third party.

Upon termination:

  • Your right to access and use the Services will immediately cease.
  • Any unused credits in your account will be forfeited and are not eligible for refund, unless otherwise required by applicable law.
  • Active subscriptions will be cancelled and no further charges will be made.
  • Provisions of these Terms that by their nature should survive termination will remain in effect, including but not limited to Sections 10, 12, 13, 14, and 16.

16. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction and venue of such courts.

17. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PowerfulTools regarding your use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral, regarding the subject matter hereof.
